Council Terms and Sessions (Amendment) Act

Preamble:

While upholding the underlining principles of L001; the Council Terms and Sessions Act; recognising and appreciating it as an attempt to improve the efficiency of the Council of the Republic, clarifying legislative procedure and provisioning it such that the composition of the Council is one of high-quality, active legislators; but also while believing that the powers granted to the Consulate, as defined by the Constitution of the Republic, to be sufficient, and any further delegation of power to represent executive consolidation harmful to the development of practices of good government; and while believing that it is the job of the Council to understand, review, revise and critique any passed legislation on grammatical and operative terms,

The Government of the League and Concord hereby:

Amends the title of "L001 - Council Terms and Sessions Bill", to "L001 – Council Terms and Sessions Act"

Replaces the following text from line two of the preamble; “L31039”; with “L000”.

Replaces the following text from line three of the preamble; “strict”; with “strictly”.

Strikes the following text from line three of the preamble, following “strict defining”, and before the limitations of”; “of”.

Replaces the following text from line three of the preamble, following “limitations”, and before “both Terms”; “of”; with “on”.

Inserts the following text in clause 2, following "and vote on legislation"; ", to be naturally limited at six months unless closed under the procedure laid out in clause 3."

Declares clause 4 of L001 to be struck and replaced with the following text; “Institutes a mandatory review process for every incumbent legislator in the Council of the Republic at the closure of a legislative term.”

Inserts the following text as a separate clause following clause 4, this new clause to be referenced further in this piece of legislation as ‘clause 5’; “The review will be conducted by a college of three independent reviewers elected amongst Council Delegates who had put themselves forward for the position following the closure of a legislative term; after 72 hours since the closure of a legislative term, Council Delegates shall, via a non-transferable vote, elect the reviewers; the three Delegates with the highest number of votes, where applicable, shall be the three occupying this position.”

Inserts the following text as a separate clause following clause 5, this new clause to be referenced further in this piece of legislation as ‘clause 6’; “The review will consist of an evaluation of the legislative contributions the legislator provided in the outgoing legislative term, to determine the activity of certain Delegates in Council activities.”

Inserts the following text as a separate clause following clause 6, this new clause to be referred to further in this piece of legislation as ‘clause 7’; “Legislative contributions are to be defined as the degree to which a Council Delegate has participated in the introduction and discussion of legislation, voted on Bills, Motions, and Treaties, and participated in any other activities held by the Council.”

Inserts the following text as a separate clause following clause 7, this new clause to be referred to further in this piece of legislation as ‘clause 8’; “The independent reviewers, following the review process, shall compile their ultimate recommendations regarding whether to remove or retain Delegates, and submit it as a report to the Consulate, who shall be able to remove legislators based on this report, while being obligated to provide any legislator justification in the case of their removal.”

Inserts the following text as a separate clause following clause 8; “Council Delegates reserve the right to submit Motions, to be voted on by the Council as a whole, that express disagreement with any choice taken by the Consulate regarding the Review process.”
