<br />
Recognizing the need for leadership and direction for the Council of the Republic,<br />
<br />
Noting the shaky history of Council of the Republic leadership,<br />
<br />
Ensuring the ability of all members of the Council of the Republic to legislate and lead;<br />
<br />
<span style="font-weight: bold;" class="mycode_b">The Government of the League and Concord hereby:</span><br />
<br />
Reestablishes the position of Speaker of the Council, officially to be known as the Speaker of the Council of the Republic,<br />
<br />
Limits the term of the Speaker to three months, renewable once consecutively, or until the end of a legislative term, if the term should expire prior to the three month term,<br />
<br />
Establishes election procedure for the Speaker as follows:<br />
<br />
I. Elections shall be held 24 hours after the expiration of each Speaker term, and will be held 48 hours following the passage of this act.<br />
<br />
II. Elections will be set-up and monitored by the Consulate.<br />
<br />
III. Candidates for election must formally declare their candidacy and be verified by the Consulate prior to the opening of voting.<br />
<br />
IV. The voting process shall be such that every voter has the opportunity to rank relatively every candidate put forward, with all vote slates being counted equally.<br />
<br />
V. If, overall, two or fewer candidates put themselves forward for the position, a simple majority vote shall be used instead of a ranked slate.<br />
<br />
VI. For the process of tabulation, a points system shall be used, in which the candidate with the most points shall be speaker-elect. For the purpose of this, a vote for a candidate marked as the voter's first preference shall be counted in terms of points as equivalent to the total number of candidates who put themselves forward for the position. The second level preference shall be counted as the total number of candidates minus one, repeated in steps of one for each lower level of preference on the voter's slate.<br />
<br />
VII. Voting shall last for 48 hours.<br />
<br />
Grants the Speaker the following powers:<br />
<br />
I. To initiate and encourage wider participation in Council of the Republic deliberations,<br />
<br />
II. To administrate all voting procedures held within the Council of the Republic.<br />
<br />
III. To contact and encourage Citizens of The League and Concord to apply to join the Council of the Republic.<br />
<br />
Allows the Council of the Republic to impeach the Speaker of the Council under the following conditions;<br />
<br />
I. The Speaker has served for at least 10 days.<br />
<br />
II. The Council of the Republic votes via over a two-thirds majority to remove the Speaker.<br />
<br />
III. The Consulate does not overrule impeachment proceedings.<br />
<br />
Grants the Consulate the right to remove the Speaker of the Council without a Council-vote, withstanding that the reason(s) for the removal are clearly stated.]]></description>

<br />
Ensuring the ability of all members of the Council of the Republic to legislate and lead;<br />
<br />
<span style="font-weight: bold;" class="mycode_b">The Government of the League and Concord hereby:</span><br />
<br />
Reestablishes the position of Speaker of the Council, officially to be known as the Speaker of the Council of the Republic,<br />
<br />
Limits the term of the Speaker to three months, renewable once consecutively, or until the end of a legislative term, if the term should expire prior to the three month term,<br />
<br />
Establishes election procedure for the Speaker as follows:<br />
<br />
I. Elections shall be held 24 hours after the expiration of each Speaker term, and will be held 48 hours following the passage of this act.<br />
<br />
II. Elections will be set-up and monitored by the Consulate.<br />
<br />
III. Candidates for election must formally declare their candidacy and be verified by the Consulate prior to the opening of voting.<br />
<br />
IV. The voting process shall be such that every voter has the opportunity to rank relatively every candidate put forward, with all vote slates being counted equally.<br />
<br />
V. If, overall, two or fewer candidates put themselves forward for the position, a simple majority vote shall be used instead of a ranked slate.<br />
<br />
VI. For the process of tabulation, a points system shall be used, in which the candidate with the most points shall be speaker-elect. For the purpose of this, a vote for a candidate marked as the voter's first preference shall be counted in terms of points as equivalent to the total number of candidates who put themselves forward for the position. The second level preference shall be counted as the total number of candidates minus one, repeated in steps of one for each lower level of preference on the voter's slate.<br />
<br />
VII. Voting shall last for 48 hours.<br />
<br />
Grants the Speaker the following powers:<br />
<br />
I. To initiate and encourage wider participation in Council of the Republic deliberations,<br />
<br />
II. To administrate all voting procedures held within the Council of the Republic.<br />
<br />
III. To contact and encourage Citizens of The League and Concord to apply to join the Council of the Republic.<br />
<br />
Allows the Council of the Republic to impeach the Speaker of the Council under the following conditions;<br />
<br />
I. The Speaker has served for at least 10 days.<br />
<br />
II. The Council of the Republic votes via over a two-thirds majority to remove the Speaker.<br />
<br />
III. The Consulate does not overrule impeachment proceedings.<br />
<br />
Grants the Consulate the right to remove the Speaker of the Council without a Council-vote, withstanding that the reason(s) for the removal are clearly stated.]]></content:encoded>

Through the <a href="https://www.nationstates.net/page=dispatch/id=1209213" target="_blank" rel="noopener" class="mycode_url">Constitution of the Republic</a>, the Council of the Republic is empowered to petition the Consulate to implement regional policies through formally convened votes (III.II.I) Subsequently, the Consulate has the authority to issue Consulate Orders that outline change in said regional policy (II.II.XII) that is passed by the Council of the Republic through the form of Acts.<br />
<br />
The Consulate of the Republic, while working with the original author of the <a href="https://theleague-ns.com/forum/showthread.php?tid=412" target="_blank" rel="noopener" class="mycode_url">Council Terms and Sessions Act</a>, has come to the conclusion that the legislated Council votes for independent reviewers to carry out a post-term mandatory review process is redundant in the case of exactly three reviewers putting themselves forward. Furthermore, the Council Terms and Sessions Act does not include a provision for the case of less than three members of the Council putting themselves forward for the process.<br />
<br />
<span style="font-weight: bold;" class="mycode_b"><span style="text-decoration: underline;" class="mycode_u">The Office of the Consulate Hereby:<br />
</span></span><span style="font-style: italic;" class="mycode_i">Inserts </span>the following under Clause 5 of the Council Terms and Sessions Act:<br />

i. In the case of exactly three Council Delegates putting themselves forward as prospective reviewers, there shall be no non-transferable vote and the three prospective reviewers are empowered to begin carrying out the review 72 hours after the closure of a legislative term.<br />

ii. In the case of less than three Council Delegates putting themselves forward as prospective reviewers, the Consulate of the Republic may select willing members of the Consulate or Council of the Republic to serve as reviewers. Once a total of three prospective reviewers exist, the three are empowered to begin carrying out the review 72 hours after the closure of a legislative term.</div>]]></description>

While upholding the underlining principles of L001; the Council Terms and Sessions Act; recognising and appreciating it as an attempt to improve the efficiency of the Council of the Republic, clarifying legislative procedure and provisioning it such that the composition of the Council is one of high-quality, active legislators; but also while believing that the powers granted to the Consulate, as defined by the Constitution of the Republic, to be sufficient, and any further delegation of power to represent executive consolidation harmful to the development of practices of good government; and while believing that it is the job of the Council to understand, review, revise and critique any passed legislation on grammatical and operative terms,<br />
<br />
The Government of the League and Concord hereby:<br />
<br />
Amends the title of "L001 - Council Terms and Sessions Bill", to "L001 – Council Terms and Sessions Act"<br />
<br />
Replaces the following text from line two of the preamble; “L31039”; with “L000”.<br />
<br />
Replaces the following text from line three of the preamble; “strict”; with “strictly”.<br />
<br />
Strikes the following text from line three of the preamble, following “strict defining”, and before the limitations of”; “of”.<br />
<br />
Replaces the following text from line three of the preamble, following “limitations”, and before “both Terms”; “of”; with “on”.<br />
<br />
Inserts the following text in clause 2, following "and vote on legislation"; ", to be naturally limited at six months unless closed under the procedure laid out in clause 3."<br />

Declares clause 4 of L001 to be struck and replaced with the following text; “Institutes a mandatory review process for every incumbent legislator in the Council of the Republic at the closure of a legislative term.”<br />

Preamble:<br />
<br />
While understanding and appreciating the necessity of L31039 (amended here to be L000) to improve the standards of legislation proposed by the Council of the Republic, and defending its vitality in improving the efficiency of the legislative process and reducing the burden on legislators of a confusing and often unenforced and outdated legislative record, while recognising that there exists several flaws in the Act, in grammatical and operative terms that seriously impede its fitness for purpose,<br />
<br />
The Government of the League and Concord hereby:<br />
<br />
Amends the classification of the Omnibus Council Legislative Reform and Reorganisation Act from “L31039” to “L000”.<br />
<br />
Replaces the following text in the first line of the preamble to L000, also to be referred to as ‘the Act’ throughout this piece of legislation; "many The League and Concord lawmakers"; with "the numerous legislators that have contributed to the development of the Republic".<br />
<br />
Strikes line two of the preamble; "Realizing the need for reassessment of much previously passed legislation;".<br />
<br />
Replaces the following text in the third line of the preamble; “politicians of The League and Concord”; with “the legislators of the Republic”.<br />
<br />
Replaces the following text in the third line of the preamble; "region"; with "regions".<br />
<br />
Replaces the following text in the third line of the preamble; “a number of previously passed pieces of legislation”; with “a significant amount of outdated and often unenforced legislation”.<br />
<br />
Strikes line four of the preamble; “Recognizing the current inability of the Council of the Republic to pass new legislation, due in part from an overabundance of out-of-date legislation;”.<br />
<br />
Inserts the following line after the fourth line of the preamble; "Understanding the need to properly update and codify the legislative procedure undertaken by the Council;"<br />

Inserts the following clause after amended clause two, hereby referred to in this legislation as amended clause three; “Defines an ‘Act’ as a Bill which has been approved in a formally convened vote by a plurality of Council Delegates without veto by the Consulate, thus being enacted into regional law.”<br />

Inserts the following clause after amended clause three, hereby referred to in this legislation as amended clause four; “Defines a ‘proposed Motion’ as a statement proposed formally by any Council Delegate that petitions for the Council to make its opinion on a particular matter officially known, without an operative clause.”<br />
<br />
Inserts the following clause after amended clause four; “Defines a ‘Motion’ as a statement approved by a plurality of Council Delegates which officially declares the opinion of the Council on a particular matter, without an operative clause.”<br />
<br />
Strikes clause two of the Act; “Institutes a mandatory review by the Council of the Republic of all laws repealed under the clause above, for possible re-passage or amending by subsequent votes.”<br />
<br />
Replaces clause three of the Act; “Codifies Council of the Republic legislative voting procedure under the following guidelines”; with “Codifies the voting procedure to be used by the Council for proposed Motions and Bills that do not amend the Constitution of the Republic under the following regulation”.<br />
<br />
Strikes clause three, subclause one of the Act; “A private channel or discussion forum shall be used following a bill or motion being brought to vote in the Council of the Republic.”<br />
<br />
Replaces clause three, subclause two of the Act; “A poll or other voting apparatus shall be released with the options “Yea”, “Nay”, or “Abstain”, in reference to the proposed bill or motion.”; with “Following a proposed Motion or Bill being moved to vote, all Delegates shall be given the opportunity to vote in favour (to be solidified through the option to vote “Yea”), against (to be solidified through the option to vote “Nay”), or in neutrality (to be solidified through the option to vote to “Abstain”) of the proposed Motion or Bill.”<br />

Replaces the following text in clause three, subclause three of the Act; “All Council of the Republic and Consulate members”; with “All Council Delegates”.<br />

Replaces the following text in clause three, subclause three of the Act; “at the polls opening and given access to discuss within the private channel or forum”; with “once the vote is formally opened, with every Delegate given the opportunity and ability to discuss the proposed Motion or Bill within, as appropriate, the private and public meeting locations, as outlined in Article Three, Section Two, Subsection VI of the Constitution”.<br />

Strikes the following text from clause three, subclause four; “(from the opening of the polls)”.<br />
<br />
Replaces the following text in clause three, subclause four; “members of the Council of the Republic” with “Council Delegates”.<br />

Strikes the following text from clause three, subclause four; “The voting period may be extended on requests from Council or Consulate members. All members of the Council of the Republic are expected to vote, whether it be “Yea”, “Nay”, or “Abstain”, on every bill or motion, and a failure to vote without just cause may be considered grounds for removal from the Council.”<br />
<br />
Inserts the following subclause following clause three, subclause four, to be referred to in this legislation as clause three, amended subclause five; “The voting period may be extended upon the reasonable request of a Council Delegate, based upon their own inability to vote within the designated time period.”<br />
<br />
Inserts the following subclause following clause three, amended subclause five; “All Council Delegates are expected to vote on every proposed Motion or Bill brought to vote, and a failure to vote without just cause may be considered grounds for removal from the Council, under the regulations set out in L001.”<br />
<br />
Replaces the following text in clause three, subclause five; “or an otherwise Consulate-designated Council member”; with “or an Consulate-selected extra-consular Council Delegate”.<br />
<br />
Replaces the following text in clause three, subclause five; “within 2 hours of the end of the voting period, at which time the bill will either fail or pass”; with “within two hours of the end of the voting period, at which time, if a plurality of Council Delegates have voted in favour of the passage of the proposed Motion or Bill, it shall be passed, whereas if a plurality of Council Delegates have voted against the passage of the proposed Motion or Bill, it shall fail”.<br />

Inserts the following subclause after clause four, subclause two; “In contrast to other Bills, votes on Bills that amend the Constitution shall only include options to vote for (“Yea”), or against (“Nay”) the passage of the legislation.”<br />

Replaces the following text in clause four, subclause three; “, and the results must be announced immediately following”; with “. The results of the vote must be announced within two hours of the end of the voting period.”<br />
<br />
Replaces clause four, subclause four; “For any constitutional amendment to pass, a two-thirds majority of “yea” is required to pass. If a proposed amendment reaches past strict majority but fails to reach the two-thirds majority, the Consulate may elect to reintroduce the legislation to another vote. Preamble:<br />

While understanding and appreciating the necessity of L31039 (amended here to be L000) to improve the standards of legislation proposed by the Council of the Republic, and defending its vitality in improving the efficiency of the legislative process and reducing the burden on legislators of a confusing and often unenforced and outdated legislative record, while recognising that there exists several flaws in the Act, in grammatical and operative terms that seriously impede its fitness for purpose,<br />
<br />
The Government of the League and Concord hereby:<br />
<br />
Amends the classification of the Omnibus Council Legislative Reform and Reorganisation Act from “L31039” to “L000”.<br />
<br />
Replaces the following text in the first line of the preamble to L000, also to be referred to as ‘the Act’ throughout this piece of legislation; "many The League and Concord lawmakers"; with "the numerous legislators that have contributed to the development of the Republic".<br />
<br />
Strikes line two of the preamble; "Realizing the need for reassessment of much previously passed legislation;".<br />
<br />
Replaces the following text in the third line of the preamble; “politicians of The League and Concord”; with “the legislators of the Republic”.<br />
<br />
Replaces the following text in the third line of the preamble; "region"; with "regions".<br />
<br />
Replaces the following text in the third line of the preamble; “a number of previously passed pieces of legislation”; with “a significant amount of outdated and often unenforced legislation”.<br />

Inserts the following clause after amended clause three, hereby referred to in this legislation as amended clause four; “Defines a ‘proposed Motion’ as a statement proposed formally by any Council Delegate that petitions for the Council to make its opinion on a particular matter officially known, without an operative clause.”<br />

Inserts the following clause after amended clause four; “Defines a ‘Motion’ as a statement approved by a plurality of Council Delegates which officially declares the opinion of the Council on a particular matter, without an operative clause.”<br />
<br />
Strikes clause two of the Act; “Institutes a mandatory review by the Council of the Republic of all laws repealed under the clause above, for possible re-passage or amending by subsequent votes.”<br />
<br />
Replaces clause three of the Act; “Codifies Council of the Republic legislative voting procedure under the following guidelines”; with “Codifies the voting procedure to be used by the Council for proposed Motions and Bills that do not amend the Constitution of the Republic under the following regulation”.<br />
<br />
Strikes clause three, subclause one of the Act; “A private channel or discussion forum shall be used following a bill or motion being brought to vote in the Council of the Republic.”<br />

Inserts the following subclause following clause three, subclause four, to be referred to in this legislation as clause three, amended subclause five; “The voting period may be extended upon the reasonable request of a Council Delegate, based upon their own inability to vote within the designated time period.”<br />
<br />
Inserts the following subclause following clause three, amended subclause five; “All Council Delegates are expected to vote on every proposed Motion or Bill brought to vote, and a failure to vote without just cause may be considered grounds for removal from the Council, under the regulations set out in L001.”<br />
<br />
Replaces the following text in clause three, subclause five; “or an otherwise Consulate-designated Council member”; with “or an Consulate-selected extra-consular Council Delegate”.<br />
<br />
Replaces the following text in clause three, subclause five; “within 2 hours of the end of the voting period, at which time the bill will either fail or pass”; with “within two hours of the end of the voting period, at which time, if a plurality of Council Delegates have voted in favour of the passage of the proposed Motion or Bill, it shall be passed, whereas if a plurality of Council Delegates have voted against the passage of the proposed Motion or Bill, it shall fail”.<br />

Strikes clause three, subclause six; “Bills and motions need a strict majority of “yea” votes to pass and become legislation. Any failure to reach a strict majority results in the failure of the bill or motion”.<br />

Replaces clause four; “Solidifies constitutional amendment voting procedure under the following guidelines”; with “Codifies the voting procedure to be used by the Council for Bills that do amend the Constitution of the Republic under the following regulation”.<br />

Replaces clause four, subclause one; “The initiation of constitution amendment voting procedure shall follow the legislative voting procedure set out above under the first three points, with the poll being amended to only include “Yea” or “Nay” options”; with “Any Bill that includes within its operative clause an amendment to the Constitution of the Republic shall be voted on under the same regulations outlined in clause three, subclauses one and two.”<br />

<span style="font-style: italic;" class="mycode_i">Noting</span> the need for strictly defining the limitations on both Terms and Sessions;<br />

<span style="font-style: italic;" class="mycode_i">Perceiving </span>the need for certain restrictions to be placed on the Council of the Republic to ensure the retention of valuable legislators;<br />
<br />
<span style="font-style: italic;" class="mycode_i">Defending </span>the contributions of effective lawmakers and their right to remain in government;<br />
<br />
<span style="font-weight: bold;" class="mycode_b">The Government of the League and Concord hereby:</span><br />
